Pune Regulator Flags Delays In Homebuyer Refunds

A recent ruling by Maharashtra’s real estate regulator has brought renewed attention to homebuyer refund obligations in Pune, after a developer was directed to return funds to purchasers who withdrew within days of booking over design limitations. The case underscores the growing scrutiny of project disclosures and the need for greater accountability in residential transactions.

The dispute arose from bookings made in a large township project in Hinjewadi, where two purchasers intended to combine adjacent units into a single residence. Within days of submitting their application, they discovered that the structural configuration did not allow such a merger. The buyers subsequently sought cancellation before any formal sale agreement was executed. Despite acknowledging the cancellation request, the developer did not provide timely evidence of repayment, prompting the buyers to approach the regulator. While the developer later claimed that the amount had been returned in full, the authority found no verifiable documentation to support this assertion during proceedings.

In its order issued earlier this month, the regulator directed the developer to complete the homebuyer refund within a fixed timeframe, excluding statutory payments such as taxes and registration charges. It also clarified that failure to comply would attract interest linked to benchmark lending rates, reinforcing financial accountability for delays.Urban policy observers say the case highlights a recurring gap between contractual clauses in application forms and regulatory protections afforded under real estate law. Developers often include provisions allowing forfeiture of a portion of booking amounts, but such clauses may not hold when cancellations occur before formal agreements or where project disclosures are inadequate.For buyers, particularly in rapidly expanding peri-urban zones like Hinjewadi, the ruling signals the importance of verifying technical feasibility before committing funds. Industry experts note that “jodi” or combined apartments an increasingly popular demand in urban housing require clear architectural provisions, not just marketing assurances. The episode also raises broader questions about transparency in project design and communication.
