Mumbai Homebuyers Still Await MahaRERA Compensation Payouts

Maharashtra’s homebuyers have received about 45 per cent of the compensation the state real estate regulator has ordered developers to pay since 2017. Only ₹369.45 crore has been recovered against orders worth ₹1,037.86 crore. Most of the unpaid ₹668.41 crore sits in Mumbai, Pune and Thane, where delayed-flat disputes are concentrated. The state has now named dedicated recovery officers in every district, but buyers’ wait for payment remains long.

The regulator can decide complaints and order compensation, but it cannot collect the money itself. If a developer ignores an order, a recovery warrant goes to the district collectorate, and revenue officials pursue it under the state’s land revenue law. A regulatory official said resident deputy collectors and additional collectors in each district are now designated recovery officers, aiming to close the coordination gaps that slowed this process. Collections are speeding up. About ₹260 crore was recovered between May 2017 and December 2025, and ₹110 crore has been collected in 2026 alone. Even so, MahaRERA compensation recovery remains well short of what buyers have been awarded.

The shortfall is concentrated in the biggest housing markets. Mumbai Suburban has recovered ₹142.31 crore of ₹415.93 crore ordered, Mumbai City ₹85.80 crore of ₹231.81 crore, and Pune ₹68.63 crore of ₹230.45 crore. Thane City and Alibaug trail in absolute terms. Together, these five jurisdictions hold ₹647.65 crore of unpaid dues, roughly 97 per cent of the statewide balance. Seven districts, including Nagpur and Nashik, have cleared their pending amounts. An official cautioned that this says nothing about how long buyers waited. Legal obstacles block a further ₹209.16 crore. Of this, ₹104.70 crore is tied up before the National Company Law Tribunal, which handles company insolvency, and ₹104.46 crore falls under a state law that lets authorities attach the assets of firms accused of defrauding depositors. In both situations, regular recovery cannot proceed. The regulator describes its roughly 45 per cent rate as the highest among India’s state authorities, though that figure compares money collected with the value of orders, not the share of buyers paid. Advocates who practise before the regulator say recovery also depends on lenders and mortgaged properties, and that buyers lack visibility into what happens to a warrant once it reaches the collector.

The delay has real costs. Families often pay loan instalments on a flat they cannot enter while also paying rent and legal fees. That ties up household savings and weakens trust in the housing market, which is a particular burden for first-time and lower-income buyers. The next test is whether MahaRERA compensation recovery keeps the 2026 pace and whether authorities publish case-wise execution status. Buyers will want regular updates, and the system will need clearer timelines to show that a favourable order leads to payment.
