Mumbai’s real estate sector, the Maharashtra Housing and Area Development Authority (Mhada) has successfully reclaimed an eight-acre plot in the prime Juhu locality, after a protracted legal battle lasting two decades. The plot, which is located opposite Ritambhara College, is valued at approximately Rs 2,000 crore, making it a highly valuable piece of real estate in one of Mumbai’s most sought-after areas.

The land had been under the possession of a private builder for the past 20 years, during which time it was subject to numerous legal disputes. The situation reached a turning point recently when the Bombay High Court (HC) vacated a stay on removing illegal structures from the plot. As a result, Mhada was finally able to take physical possession of the land and clear out the unauthorised constructions that had been put up by the builder. The plot in question has been a focal point of controversy due to allegations of fraudulent activities and encroachments. In 2021, local BJP MLA Ameet Satam raised concerns with Mhada and the Slum Rehabilitation Authority (SRA) about the builder’s attempts to convert the plot into a commercial event space. Satam’s complaints highlighted that the builder had concretised the 18,000 square metres of land, a space that was supposed to remain undeveloped and was never intended for commercial use. This development was discovered when it was found that the builder had been using the land for events despite Mhada’s possession notice.

In response to these concerns, Mhada took “paper possession” of the plot in 2022. However, the builder approached the Bombay High Court, securing a stay on the possession notice, which delayed Mhada’s ability to take physical control of the land. This marked the start of a long and contentious legal battle, with Mhada unable to act until the court ruled in its favour, allowing the removal of the illegal structures. After securing physical possession of the plot, Mhada has now taken immediate action to prevent any further encroachment, erecting a board on the land to ensure that it is not usurped. Ameet Satam, who played a pivotal role in bringing the issue to light, called the reclamation of the land “a collective and significant victory for residents and architects,” stressing that it marked the end of a “mega land scam” in the making.

Satam further stated that the builder, Kiran Hemani of Bombay Slum Redevelopment Corporation, had previously dismissed Mhada’s claims as baseless but had failed to respond to any queries following the land’s official reclamation. This incident is a reminder of the ongoing challenges in Mumbai’s real estate market, where illegal land dealings and encroachments have remained persistent issues. The land’s market value, estimated at around Rs 2,000 crore, holds immense potential for redevelopment. The victory is not only a significant one for Mhada but also for the local residents who have long faced the consequences of illegal encroachments in their neighbourhood. With Mhada now in possession of the land, there is hope that the area will be used for the purposes it was originally intended, offering much-needed space for public housing and community development. This incident also sheds light on the importance of vigilance and proactive measures to prevent land-related scams, especially in high-value areas like Juhu. As Mumbai continues to grow, securing land for public use and combating illegal encroachments will remain an ongoing challenge for authorities.
