UP RERA Relief Faces Pushback From Western UP Developers

Noida/Lucknow: A dispute over project deadline relief is emerging between developers in western Uttar Pradesh and the state’s real estate regulator, after UP RERA attached compliance conditions to a four-month extension for projects affected by West Asia-linked supply disruptions. The disagreement could influence construction schedules, homebuyer expectations and the pace at which delayed housing projects move towards completion.

UP RERA’s decision followed a July 31 advisory from the Ministry of Housing and Urban Affairs, which asked state regulators to provide four months of additional time to eligible registered projects affected by the disruption. The Centre cited supply-chain interruptions and material shortages and invoked the force majeure framework under RERA. The state regulator has limited the relief to projects whose original, revised or previously extended completion dates fall between February 28 and October 31, 2026. Projects that already hold completion or occupancy certificates are outside the arrangement. The extension covers both registration validity and the stipulated completion period. The conditions are at the centre of the dispute. Developers seeking the benefit must meet specified reporting and documentation requirements, including pending quarterly progress reports and the annual audit report for 2024-25. The sanctioned map, layout or building plan must also meet the regulator’s prescribed validity requirement.

CREDAI Western UP, representing more than 400 developers, has asked the authority to reconsider its approach. The association argues that the Centre’s advisory was intended as broad force majeure relief and that additional eligibility filters have narrowed its practical reach. It has also sought a hearing and requested that enforcement measures be kept in abeyance while the issue is reviewed. The regulatory tension highlights a wider challenge in urban housing: how to recognise genuine construction disruptions without weakening accountability to buyers. Compliance reporting can provide regulators with visibility over stalled projects, but delays in resolving eligibility disputes can also make completion schedules harder for residents to plan around.

For homebuyers, the immediate concern is not simply whether developers receive additional time, but whether revised timelines translate into measurable progress on sites. A transparent system that distinguishes genuine supply-chain disruption from avoidable delay will be important as Uttar Pradesh continues to expand its housing and infrastructure footprint. The next step rests with UP RERA, which will have to balance regulatory oversight with the need for workable relief. Any revision should provide clarity to developers while keeping project progress and buyer interests central to the implementation of the extension.
