KRERA Order Exposes Gaps In Bengaluru Layout Delivery

A regulatory order in Bengaluru has spotlighted persistent gaps in urban project delivery, with the state real estate authority directing a public development agency to compensate a plot buyer and complete long-pending civic infrastructure within a fixed timeline. The ruling underscores how incomplete basic amenities continue to undermine the usability of residential layouts, raising wider concerns about planning accountability in fast-growing cities.

The case centres on a plotted development in south-west Bengaluru where, despite full payment and formal possession processes being completed years ago, essential services such as water supply, drainage, electricity, internal roads, and street lighting remained absent. The authority concluded that such deficiencies render the property effectively unusable, reinforcing that possession without infrastructure does not meet statutory obligations. Under provisions of the Real Estate (Regulation and Development) framework, the regulator held the developer accountable for delays extending over several years. It ordered financial compensation exceeding ₹22 lakh, calculated as interest on the buyer’s investment over the delay period. The authority also mandated that the project be brought up to habitable standards within two months, signalling a stricter enforcement approach in cases where infrastructure commitments remain unmet.

Urban planners note that this ruling highlights a structural issue in peripheral city expansion, where land is often parcelled and sold before trunk infrastructure is fully in place. This pattern not only delays habitation but also increases reliance on private solutions such as borewells and diesel generators, adding environmental stress and long-term costs for residents. In a city already facing water scarcity and mobility constraints, such fragmented development can deepen urban inequities. From a citizen perspective, the financial burden is significant. Buyers often service housing loans while being unable to occupy or build on their plots, creating a dual strain of rent and EMIs. Industry observers say the order reiterates the principle that real estate delivery must go beyond legal possession to include functional liveability an aspect critical to sustainable urban growth.

The Bengaluru case also aligns with a broader regulatory trend where authorities are increasingly interpreting “possession” as contingent on infrastructure readiness. This shift could influence how future projects are phased, pushing developers and public agencies to synchronise land allotment with infrastructure rollout more closely.For policymakers, the episode raises questions about governance models in large-scale layouts developed on acquired land. Ensuring timely delivery of civic services is essential not only for consumer protection but also for building climate-resilient and resource-efficient urban extensions. As Bengaluru continues to expand outward, the emphasis is likely to move towards integrated planning, where housing supply is matched with reliable infrastructure. The outcome of such cases may shape both buyer confidence and institutional accountability in India’s evolving real estate landscape.
