Hyderabad TG RERA Freezes Two Flats in Dispute

The Telangana Real Estate Regulatory Authority has temporarily blocked the sale or transfer of two flats in the Suryodaya Abode project after two homebuyers alleged that units covered by their 2022 agreements were later transferred to other parties. The interim order keeps alternative homes available while the dispute is examined, highlighting the importance of protecting buyers’ contractual interests during prolonged real estate proceedings. TG RERA’s official orders list records both matters as interim orders dated September 16, 2026.

The dispute concerns two purchasers who entered into separate Agreements of Sale with the developer and its directors in April 2022. The buyers told the regulator that they had made substantial payments and remained willing to complete their obligations, but alleged that the agreed apartments in Block-B were subsequently conveyed to third parties. Instead of seeking only monetary relief, the buyers asked for alternative accommodation within the same development. They identified Flat 402 and Flat 401 in Block-A as vacant units and sought interim protection against their further sale, transfer or encumbrance. That request is significant because property disputes can become harder to resolve once a disputed unit is transferred again. A subsequent transaction can create additional third-party interests, potentially complicating the regulator’s ability to provide effective relief to an original allottee.

At the September 10 hearing, the respondents’ counsel sought additional time to submit their response. TG RERA reviewed the agreements, payment records and other material placed before it and found sufficient grounds, at this stage, to preserve the two alternative flats. The authority also made clear that the respondents’ failure to file their counters at that point should not be treated as acceptance of the buyers’ allegations. Under the interim directions, Flat 402 in Block-A, linked to Complaint No. 349 of 2026, and Flat 401 in Block-A, linked to Complaint No. 397 of 2026, cannot be alienated, transferred, encumbered or used to create third-party rights until the next hearing. The restraint has been issued under Section 36 of the Real Estate (Regulation and Development) Act, 2016, read with Rule 34(1) of the Telangana RERA Rules. The authority has also warned that breach of the directions may lead to action under Section 63.

For Hyderabad’s housing market, the case underlines a wider issue around transaction certainty. When agreements, payments and possession do not move together, buyers can face prolonged financial and legal uncertainty even after committing significant capital. The TG RERA matter will return for hearing on November 2, 2026, when the respondents are expected to file their counters. Until then, the restraint remains an interim safeguard and does not determine the final rights of either side.
