India Competition Ruling Eases Stainless Steel Dispute

India’s competition regulator has closed an antitrust complaint concerning stainless steel supply arrangements,concluding that available evidence did not justify a formal investigation into procurement practices involving an Indian stainless steel producer and several Indonesian suppliers.

The decision carries wider significance for industrial supply chains that underpin construction, transport, manufacturing and urban infrastructure, where uninterrupted access to critical raw materials remains essential.The Competition Commission of India (CCI) examined allegations that procurement agreements for nickel-rich stainless steel inputs had unfairly restricted market access for competing domestic manufacturers. After reviewing the material placed before it, the regulator found no prima facie indication that competition law had been breached or that rival businesses had been prevented from sourcing essential raw materials.The complaint originated from an unnamed participant in India’s downstream stainless steel industry, which argued that sourcing arrangements with Indonesian producers created an uneven competitive environment. Nickel-bearing slabs and hot-rolled coils are crucial feedstocks for stainless steel production, and India’s limited domestic nickel availability means manufacturers depend heavily on imported supplies. The regulator, however, determined that the available evidence did not establish market foreclosure or abuse of dominance.

The order also reviewed a distributor engagement programme operated by the company after concerns were raised that participating dealers could face commercial restrictions.The Commission concluded that enrolment in the programme remained voluntary and found no indication that it compelled distributors to limit business with competitors or distorted market choice.The outcome comes at a time when India’s stainless steel sector is expanding alongside investments in metro rail systems, water infrastructure, renewable energy projects, commercial buildings and urban mobility networks.
