MSHRC Orders Fair Compensation For Kalyan Property Owners

The Maharashtra State Human Rights Commission (MSHRC) has directed the Thane district collector to provide compensation to a landowner whose property in Kalyan was acquired for the Mumbai–Vadodara National Highway project, highlighting procedural gaps in large-scale infrastructure land acquisitions. The order addresses claims of financial hardship caused by delayed payments, underscoring the intersection of urban development, human rights, and legal compliance.

The commission’s decision came after a complaint filed by Mohamed Latif Shaikh, whose land, including a residential home and commercial shop, was acquired for the expressway project managed by the National Highways Authority of India (NHAI). Shaikh alleged that he had not received compensation for several years, leaving him without a stable livelihood. In its order, the MSHRC emphasised that the state has a statutory obligation to provide fair and timely compensation to property owners affected by public infrastructure projects. According to commission records, Shaikh’s complaint dates back to December 2024, and a prior directive had asked the Thane collector to conduct a fact-finding inquiry into the acquisition and compensation status. The commission noted the collector failed to respond, effectively accepting the claims in Shaikh’s petition. Observers say such non-participation can exacerbate disputes and erode trust between citizens and urban development authorities, particularly in high-density corridors like Kalyan.

Shaikh, along with other affected individuals, has also approached the Bombay High Court regarding land acquired under the Maharashtra Project Affected Persons Rehabilitation Act, 1999, and the Land Acquisition Act. The petition highlights ongoing challenges for small landowners, including partial demolitions of property without due process and delays in receiving compensation. Tenants and landowners affected in Baneli, Kalyan, had been occupying plots for over a decade, further complicating the compensation and rehabilitation process. Urban planners and legal analysts note that highway expansion projects, while critical for regional connectivity and economic growth, often encounter friction due to gaps in rehabilitation and compensation frameworks. Timely settlement is essential not only to safeguard livelihoods but also to maintain project timelines and public confidence. Experts point out that unresolved claims can lead to protracted legal disputes, delays in construction, and increased costs for both government agencies and contractors.

The MSHRC’s directive is expected to set a procedural precedent for similar greenfield infrastructure projects in Maharashtra, emphasising accountability and adherence to due process. By mandating compensation within a defined period, the commission reinforces the principle that economic development must balance citizen rights and urban justice. As the Mumbai–Vadodara corridor moves toward completion, ensuring transparent compensation mechanisms will be critical for achieving equitable urban development outcomes.
