Mumbai Homeowners Get Fresh Path To Occupation Certificates

Mumbai’s civic administration is moving towards implementing an Occupation Certificate (OC) amnesty framework after the Brihanmumbai Municipal Corporation (BMC) House approved the policy on August 18. The measure could affect nearly 25,000 residential buildings and about 12 lakh homeowners, giving long-occupied properties a route towards formal civic certification.

An OC confirms that a completed building meets the applicable planning and safety requirements for occupation. For homeowners, its absence can create practical problems around property transactions, redevelopment, financing and documentation. The issue is particularly significant in Mumbai, where older buildings can remain occupied for years while unresolved approvals continue to affect residents. The Mumbai OC amnesty is not, however, a blanket route for making unauthorised construction legal. Eligibility remains tied to specific planning records and occupancy conditions. Buildings must have valid Intimation of Disapproval (IOD) and Commencement Certificate (CC), while occupation must be established as having taken place before November 17, 2016. Documents such as property-tax records and electricity bills may be used as evidence.

The framework also places a size limit on residential units. Homes exceeding 80 square metres, or roughly 861 square feet, are outside the scheme’s benefits. Predominantly residential buildings can qualify, while eligible schools and hospitals are also covered. Commercial premises inside residential buildings may receive an OC in specified circumstances, although they do not receive the same financial concessions. For housing societies, another potential hurdle is the requirement for a No Objection Certificate from the original construction applicant or development-rights holder. Where that document is unavailable, the civic authority can issue notice to the relevant developer, owner or original applicant. This could become important in older projects where developers are no longer active or residents have struggled to complete documentation.

The policy also has a wider real-estate implication. A clearer OC status can improve the documentation trail around apartments and reduce uncertainty during resale or redevelopment. For buyers covered by the broader RERA ecosystem, clearer project and occupancy records can also strengthen transparency, although the BMC amnesty itself is a municipal OC mechanism rather than a RERA scheme. Urban planners say the larger test will be implementation. A workable process must reduce procedural delays without weakening fire safety, structural checks or planning controls. For Mumbai, formalising genuinely compliant occupied buildings could improve housing security and unlock stalled redevelopment, but the process will need to distinguish administrative delays from substantive violations.
