The introduction of the Real Estate (Regulation and Development) Act (RERA), 2016 has transformed India’s real estate sector, bringing a much-needed layer of accountability and transparency. Before RERA, homebuyers often struggled with project delays, misinformation, and lack of legal recourse against errant builders. The Act has now established a regulatory framework that mandates timely project completion, fair pricing, and a dispute resolution mechanism. According to industry experts, since its implementation, RERA has instilled confidence in homebuyers, reducing project delays by nearly 40% in some states. However, while developers are now bound by stricter compliance measures, implementation challenges and inconsistencies across states continue to raise concerns.

Enhancing Buyer Protection and Market Stability

RERA mandates that developers must register their projects with the regulatory authority, disclose project details, and adhere to strict timelines. Failure to comply can lead to financial penalties or even project cancellations. The Act also stipulates that 70% of funds collected from homebuyers must be deposited in an escrow account to prevent fund diversion—a common malpractice before its enactment. This has significantly enhanced financial discipline in the sector. Moreover, homebuyers now have a structured grievance redressal mechanism, reducing legal disputes and ensuring quicker resolutions. Despite these strides, some loopholes remain, particularly in terms of enforcement. Reports suggest that in certain states, over 30% of registered projects have failed to meet RERA’s compliance requirements, highlighting the need for stricter monitoring.

Sustainability and Urban Development

Beyond consumer protection, RERA also indirectly supports sustainable urban growth. By curbing fraudulent practices and ensuring project completion, the Act reduces the number of stalled projects, thereby minimising environmental degradation and resource wastage. Additionally, compliance with RERA encourages planned development, as developers are required to submit clear land-use details and construction blueprints, ensuring urban expansion aligns with environmental considerations. However, the Act does not explicitly mandate green building practices, which remains a crucial gap in India’s push for sustainable infrastructure.

Civic Issues and the Road Ahead

While RERA has improved market transparency, its effectiveness varies across states due to inconsistent implementation. In cities like Mumbai and Bangalore, where real estate is a critical driver of urban expansion, RERA compliance has helped streamline the sector. However, in smaller cities, many projects still operate without RERA registration, leaving homebuyers vulnerable. Strengthening regulatory oversight and ensuring nationwide uniformity in implementation will be essential for RERA to achieve its full potential. Additionally, integrating smart technology for tracking project statuses and enhancing public awareness about RERA rights could further empower homebuyers.
