Supertech Delays Raise RERA Questions For Homebuyers

The revival of 16 stalled Supertech housing projects has come under renewed judicial scrutiny after the National Company Law Appellate Tribunal (NCLAT) sought a progress report from the committee overseeing their completion. The direction highlights a widening gap between promised construction timelines and ground-level progress, keeping thousands of homebuyers in prolonged uncertainty across Uttar Pradesh, Haryana, Uttarakhand and Karnataka.

The tribunal’s latest intervention follows complaints from stakeholders that key milestones fixed earlier this year have not been achieved. The May 2026 schedule required the process for awarding construction work to begin by the end of July, followed by the start of construction within the subsequent month. The committee has now been given two weeks to explain what action has been taken on the projects. For homebuyers, the issue extends beyond construction delays. These developments represent long-term financial commitments, while stalled housing also leaves completed infrastructure, land and neighbourhood services underused. Urban planners note that prolonged project uncertainty can weaken confidence in large residential markets and complicate the efficient use of existing urban infrastructure.

The Supertech housing projects were placed under a revival framework after insolvency proceedings against the developer began in 2021. In December 2024, NCLAT directed NBCC to take up 16 stalled developments under a monitored mechanism. The portfolio covers nearly 50,000 housing units across four states. The Supreme Court subsequently upheld the arrangement in February 2026, prioritising completion for affected homebuyers. RERA compliance has added another layer to the recovery process. NCLAT declined in May to grant NBCC an exemption from statutory RERA requirements, after which NBCC approached the Supreme Court. The apex court agreed to hear the matter, with the issue scheduled for consideration later in September. This makes regulatory compliance an important part of the wider question of how stalled projects can be completed without weakening safeguards available to buyers.

The tribunal also took note of complaints about waterlogging in basements at two projects and concerns over unpaid employee salaries. Such issues underline that project revival is not limited to restarting construction; it also involves maintaining existing assets, resolving operational gaps and protecting the interests of residents and workers. The committee’s report is now expected to provide greater clarity on contract awards, construction readiness and the next steps for the Supertech housing projects. The matter is scheduled to return before NCLAT on September 14, when stakeholders are likely to seek clearer timelines and measurable progress.
