Hyderabad Toopran Lands Cleared From Waqf Listing

Hyderabad: The Telangana High Court has set aside a 2001 Gazette notification that classified 5.8 acres of land in Toopran village, Medak district, as waqf property, after finding that the Telangana Waqf Board had not produced records showing that the statutory survey and enquiry process had been followed. The September 15 order has implications for private landholders whose properties were included in historical waqf listings. 

Justice Laxmi Narayana Alishetty passed the order on a petition filed by 39 people who claimed that the disputed parcels were private patta lands inherited from their families. They relied on occupancy rights certificates, pattadar passbooks, title documents and revenue records to support their claims of ownership and possession. The petitioners said they became aware of the waqf classification when they approached registration authorities for property transactions. They argued that they had not received individual notices and were not given an opportunity to raise objections before their lands were included in the list. The Waqf Board disputed this position. It maintained that a survey of waqf properties had been conducted in the 1960s and that public announcements had been made in villages. It also argued that the Gazette notification had attained finality and that the petitioners had other legal remedies available to them.

The court’s examination focused on whether the statutory process supporting the notification could be demonstrated through records. According to the judgment as reported, the Board did not produce the survey report, survey commissioner’s proceedings, enquiry material, records of objections or evidence of public proclamation. That procedural issue was central to the ruling. The court held that the survey and enquiry contemplated under Sections 4 and 5 of the Waqf Act, 1954 form the foundation for publishing a waqf list. Gazette publication alone could not replace those statutory steps where the classification could have serious civil consequences for private landowners. The Toopran land dispute also illustrates the difficulties created when historical property records, religious endowment records and present-day land ownership claims overlap. Such disputes can affect the ability of owners to register, transfer or otherwise deal with land, particularly when properties appear on prohibited or restricted lists.

The ruling does not establish a general finding about all waqf properties in Telangana. It concerns the specific notification and properties covered by the petition. Several other cases involving older waqf notifications have also been before the Telangana High Court, with some orders turning on whether the statutory process was followed. For Telangana’s land administration, the case highlights the importance of maintaining accessible survey, enquiry and ownership records. Clear documentation can reduce uncertainty for landowners while also helping authorities protect legitimately recognised endowment properties. The immediate consequence is that the 2001 notification, insofar as it covered the petitioners’ Toopran properties, has been set aside. The broader significance lies in the court’s emphasis on due process: property classifications with substantial legal consequences must be supported by the procedure and records required by law.
